Give-Back Program — Terms & Conditions

Read this first. The SciMed Give-Back Program is NOT a tax-deductible charitable donation program. SciMed Scientific Equipments LLC is a for-profit US business, not a 501(c)(3) tax-exempt organization. Donations to this program are ordinary business revenue and cannot be claimed as charitable tax deductions.
1. What this program is
The SciMed Give-Back Program is a voluntary customer donation program operated by SciMed Scientific Equipments LLC ("SciMed," "we," "our," "us"), a limited liability company organized under the laws of California, USA, headquartered at 163 Silcreek Drive, San Jose, CA 95116.
Under this program:
- Customers may voluntarily contribute money ("donations") when placing an order at scimedstore.com or by direct email.
- Donations enter a general program pool.
- SciMed uses pooled funds to cover the cost of shipping ring pessaries to US-resident applicants who self-report financial need.
- There is NO fixed dollar-to-pessary equivalence. SciMed determines each month how many pessaries to ship based on total pool funds and application volume.
- SciMed is not a public charity. This is a for-profit business program.
2. What this program is NOT
This program is expressly NOT:
- A tax-deductible charitable donation program.
- A partnership with any 501(c)(3) nonprofit organization.
- A grant, insurance replacement, or medical benefit.
- Solicitation under charitable pretenses.
- A guarantee of pessary delivery to any specific applicant.
- A pre-purchase of a specific pessary for a specific recipient.
3. Donor terms
3.1 Contribution
Donors may contribute via the Give-Back section on the checkout page at scimedstore.com or by direct email to sales@scimedstore.com. Minimum contribution is $1. Any amount is welcome. Donations become SciMed's business revenue and are pooled for program fulfillment.
3.2 No tax deduction
Donations are NOT tax-deductible. Donors may not claim any charitable contribution deduction on any federal, state, or local tax return based on their donation. SciMed does not issue tax-deduction receipts and will not respond to requests for such receipts.
3.3 Non-refundable
Donations become non-refundable once SciMed has committed the pool funds to a monthly fulfillment batch (typically within 30 days of donation). Refunds prior to that point are at SciMed's sole discretion.
3.4 No designation of recipient, no dollar-to-device equivalence
Donors may not designate specific individuals to receive their donated funds. All donations enter a general program pool. SciMed determines how many pessaries to ship each month based on total pool funds and application volume. There is no fixed "one donation equals one pessary" equivalence and donors are not entitled to see individual recipient outcomes.
3.5 Donor cannot also be applicant
To maintain the integrity of the program and prevent abuse, an individual who has donated to the Give-Back Program is not eligible to also apply to receive a donated pessary from the program within 12 months of their donation. This rule prevents individuals from using donations as a means to receive pessaries at a discount to retail price.
3.6 Donor privacy
SciMed may aggregate donor contribution totals for public reporting (e.g., "$X donated to date") but will not disclose individual donor identities, contribution amounts, or contact information without written consent.
4. Applicant terms
4.1 Eligibility
To be considered for a donated pessary, an applicant must:
- Be an adult woman aged 18 or older.
- Reside in the United States with a valid US shipping address.
- Self-attest a statement of financial need (no proof of income required).
- Not have received a donated pessary from SciMed in the prior 12 months.
- Not have made a donation to the Give-Back Program in the prior 12 months.
- Provide accurate personal information for shipping purposes.
4.2 Application process
Applicants apply by email to sales@scimedstore.com. Applications must include: full name, US shipping address, provider name (if any), pessary type requested, size if known, age confirmation (18+), confirmation of no prior program donation within 12 months, and a 2–3 sentence statement of financial situation.
4.3 Application review
SciMed reviews applications monthly. SciMed reserves the right to decline any application at its sole discretion, including but not limited to cases of: incomplete information, suspected fraud, duplicate application, non-US address, exceeded 12-month limit, or prior participation as a donor within 12 months.
4.4 Fulfillment timeline and no guarantee
Approved applicants typically receive their pessary within 30–60 days of approval. Fulfillment is dependent on the availability of pool funds and application volume in a given month. If demand exceeds monthly pool funds, a waitlist is maintained. Waitlist position is not transferable. Approval to any specific applicant is not guaranteed.
4.5 Size exchanges
Approved recipients may request a one-time free size exchange within 30 days of receipt if the initial size does not fit. Exchanges are funded by the same program pool and subject to availability.
4.6 Not medical advice
SciMed is not a healthcare provider. Approval to receive a donated pessary is not medical advice, is not a substitute for consultation with a licensed clinician, and does not constitute a physician-patient relationship. Applicants are strongly encouraged to consult a qualified gynecologist or urogynecologist before use.
5. Product terms
Pessaries shipped under the Give-Back Program are the same medical-grade silicone devices sold at retail on scimedstore.com. They are FDA 510(k) cleared as Class II medical devices under FDA Product Code HHN, regulated under 21 CFR 884.5350. Standard product usage, care, and safety information applies. 6. Fraud prevention
SciMed may verify applicant information through publicly available sources or by requesting additional documentation. SciMed cross-references applicant identity against the donor list to enforce the 12-month donor/applicant separation rule. Fraudulent applications, misrepresentation of eligibility, attempted circumvention of the donor/applicant separation rule, or attempted resale of donated devices may result in application denial, program suspension, and referral to law enforcement. SciMed reserves all legal remedies.
7. Data collection and privacy
Applicant and donor data (name, shipping address, statement of need, provider name) is collected only for fulfillment and integrity-verification purposes. This data is stored in SciMed's secure systems and is not shared with third parties except as required by law or for shipping/logistics purposes. Applicant and donor data is retained for 24 months and then deleted per SciMed's data retention policy. 8. Program modifications
SciMed may modify these terms, adjust program parameters (donation amounts, application requirements, fulfillment frequency), or discontinue the program at any time upon 30 days' notice posted on this page. Existing pending applications will be honored under the terms in effect at the time of application unless the program is discontinued due to fraud, legal issue, or force majeure.
9. Limitation of liability
To the maximum extent permitted by law, SciMed's total liability arising from any donation or application under this program is limited to the amount of the individual donation contribution or the retail value of one Ring Pessary Without Support ($44.99), whichever is lower. SciMed is not liable for indirect, consequential, or punitive damages of any kind arising from the program.
10. Medical device disclaimers
Ring pessaries are FDA 510(k) cleared Class II medical devices. Standard product warnings apply: consult a qualified healthcare provider before use, first-time fitting should be performed by a gynecologist or urogynecologist, discontinue use and contact a provider immediately if you experience pain, bleeding, unusual discharge, or difficulty urinating. SciMed is not liable for adverse events resulting from misuse, improper fit, or failure to seek clinical guidance.
11. Governing law and dispute resolution
These terms are governed by the laws of the State of California, USA, without regard to conflict of law principles. Any disputes arising from the Give-Back Program shall be resolved in the state or federal courts located in Santa Clara County, California. Donors and applicants waive any claim of inconvenient forum.
12. Program not affiliated with charitable organizations
SciMed's Give-Back Program is independently operated by SciMed Scientific Equipments LLC. It is NOT affiliated, endorsed, or associated with any charitable organization, 501(c)(3), medical society, or advocacy group unless explicitly stated in writing by SciMed and the third party. Any references to organizations such as APOPS, Voices for PFD, ACOG, IUGA, or others in general SciMed content are for clinical reference only and do not constitute partnership or endorsement.
13. Complete terms
These terms constitute the complete agreement between SciMed and program participants regarding the Give-Back Program. They supersede any prior oral or written representations. If any provision is found unenforceable, the remainder of these terms continues in effect.
